We stand behind the durability of your Berry Floor.
WHAT THIS WARRANTY COVERS
This warranty covers defects in materials or workmanship which relate to joint
integrity, staining, fading, wear and topical moisture resistance.
Joint Integrity
Perfect installation- Berry Floor planks lock together perfectly to ensure
close-fitting seams. The fit is a close fit, but not so close as to make
installation difficult or to not allow for normal expansion and shrinkage of
the product due to humidity changes and normal loads. Easy plank replacement -
Berry Floor planks are easily taken up to replace damaged planks.
Fade Resistance
Berry Floor will not fade from exposure to sunlight or normal artificial light.
Stain Resistance
Berry Floor will resist stains.
Wear resistance
Berry Floor decorative surface will not wear through during normal residential
use.
Topical moisture warranty
Berry Floor will resist topical water damage under normal use conditions. Berry
Floor will not delaminate at the seams, provided that water is removed
immediately and the floor is allowed to dry.
LENGTH OF COVERAGE
This warranty lasts for the useful lifetime of the product. The warranty is for the original end consumer and is not
transferable. In order for this warranty to apply, you must register your
warranty according to the instructions set forth below.
FULL WARRANTY DURING FIRST SIX YEARS AFTER DELIVERY
If a defect in materials or workmanship appears in your Berry Floor during the
first six years after delivery, Berry Floor will provide, at its choice,
either a free replacement (not including labour) of the defective Berry Floor
planks or a complete refund of the purchase price for those planks.
LIMITED PRO-RATA WARRANTY DURING THIRD THROUGH TWENTYSECOND YEARS AFTER
INSTALLATION
If a defect in materials or workmanship appears in your Berry Floor during the
seventh year after delivery, Berry Floor will provide a refund of the purchase
price for the defective Berry Floor planks in an amount that diminishes pro
rata, 5 percent per year, over the duration of the warranty, to account for
normal wear and tear. For example, if the defect arises during the seventh year
after delivery, Berry Floor will provide a refund of 95% of the purchase price
for the defective Berry Floor planks; if the defect arises during the eighth
year after delivery, the refund will be 90% of the purchase price for the
defective Berry Floor planks; and so on for each year, in the same fashion. The
refund will only be given by means of a discount on new Berry Floor planks.
WARRANTY SERVICE
In order to be entitled to the application of the present warranty, it is
necessary that your warranty is registered. To register your warranty, you must
return the Registration Certificate on the inlay of a box, with a copy of the
purchase sales receipt, within 30 days of purchasing the floor. If you need to
file a claim, do so through the retailer from whom you purchased the product.
STATE LAW
This warranty gives you specific legal rights, and you may also have other
rights, which vary from state to state.
WHAT IS NOT COVERED
Any implied warranties, including that of merchantability and fitness for a
particular purpose, are limited in duration to the duration of the express
warranty.
This warranty does not cover damage to the product in following situations:
installation error or installation not in accordance with the installation
instructions;
accident, product misuse or product abuse, such as scratches, blows, cuts or
damage caused by sand or other abrasive materials, whether caused by
contractor, a service company or a consumer;
non-residential use of the floor;
improper maintenance of the floor, not in accordance with the installation
instructions;
flooding, standing water or water that is trapped between the sub floor and the
Berry Floor.
The warranty does not cover defects that are not clearly visible, such as
surface wear, stains or fading less than one square inch in size. As far as
joint integrity is concerned, the warranty only applies if the joint breaks
open, preventing the planks to be/remain assembled. Berry Floor is not
responsible for labour charges, installation charges or similar costs.
Consequential, special incidental charges are not recoverable under this
warranty. Some states do not allow the exclusion or limitation of incidental or
consequential damages, so the above limitations or exclusions may not apply to
you.
